During the Seven (7) days FREE trial, you will
receive the fully paid subscription privileges. Resumes
will be sent to the email you specified in the submitted
form. Upon your successful signup to
receive resumes, you will receive resumes beginning the
next distribution cycle. You will receive
unlimited number of resumes – unlimited means
all resumes received by MDResume.com through the website
which are pre-screened and qualified and then forwarded
to you.
Use of Resumes
By requesting the FREE trial, you agree to receive
resumes solely for possible placement of these
candidates and will not contact them for any reason
other than for bona fide career opportunities that would
be considered normal and customary employment.
Further, you are specifically
prohibited from using information contained in received
resumes to sell or promote any products or services or
to take any other action that is misleading or
incomplete, or in violation of any Federal, State, Local
law, statute, code, rule, or regulation.
Cancellation
Your FREE Trial will end after the seven days period.
You may continue with the service by switching to the
fully paid membership service. At the end of the trial
period or upon your request, you
will be released from this agreement which will cause
this service to stop.
Termination and Rights of Refusal
Because of the specialized nature of this service,
MDResume.com reserves the right to refuse service to
anyone at any time. Further, MDResume.com may terminate
a subscription and/or free trials if it is determined that the terms and
conditions of this agreement have been violated.
Non-Transferable
Your right to use the service is not transferable and is
subject to any limits established by MDResume.com. You
may not, under any circumstances, give out resumes
received to another party without written authorization
from MDResume.com. If it is determined that resumes
received have been shared, both you and the unauthorized
user(s) will be responsible to pay for the services.
Force Majeure
MDResume.com shall not be liable or
responsible for any delay or failure in performance if
such delay or failure is due to causes beyond its
control.
Disclaimer of Warranties
THE RESUME DISTRIBUTION SERVICE AND USE OF THE MDRESUME.COM SERVICES ARE PROVIDED "AS IS". NO WARRANTY,
REPRESENTATION, CONDITION, UNDERTAKING OR TERM, EXPRESS
OR IMPLIED, STATUTORY OR OTHERWISE, AS TO THE CONDITION,
QUALITY, DURABILITY, PERFORMANCE, NON-INFRINGEMENT,
MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE OR
USE OF THE SERVICE. MDRESUME.COM MAKES NO WARRANTY WITH
RESPECT TO THE ACCURACY OR COMPLETENESS OF THE RESUMES.
MDRESUME.COM DOES NOT WARRANT THAT YOUR USE OF THE
RESUME SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR
FREE.
Limitation of Liability
IN NO EVENT WILL MDRESUME.COM BE LIABLE TO YOU OR ANY
THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL,
EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES OR
PENALTIES (INCLUDING, WITHOUT LIMITATION, FOR LOST
PROFITS) ARISING HEREUNDER OR IN CONNECTION HEREWITH,
EVEN IF MDRESUME.COM HAS BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES OR PENALTIES. WITHOUT LIMITING THE
GENERALITY OF THE FOREGOING, IN NO EVENT SHALL
MDRESUME.COM’S TOTAL AGGREGATE LIABILITY FOR ANY DAMAGES
(DIRECT OR OTHERWISE) OR PENALTIES OR LOSS TO YOU OR ANY
THIRD PARTY, REGARDLESS OF THE FORM OF ACTION OR CLAIM,
WHETHER IN CONTRACT, TORT OR OTHERWISE, EXCEED A ONE
MONTH SUBSCRIPTION FEES ACTUALLY PAID BY YOU.
Entire Agreement
This agreement constitutes the entire and only agreement
between MDResume.com and you, and shall supercede any
and all prior or contemporaneous agreements,
representations, warranties, and understandings with
respect to the services provided by or through the site,
and the subject matter of this agreement. Further, you
agree to review this agreement prior to purchase.
Purchase of the medical device resume service shall be
deemed acceptance of this agreement and you agrees to
the terms and conditions outlined in this online
agreement with respect to the services provided by
MDResume.com.
